Summary Information:

The Gkuthaarn and Kukatj People Commercial Fishers Indigenous Land Use Agreement (ILUA) was agreed under the provisions of the Native Title Act 1993 (Cth) between:

  • Richard Grant French, Michael John MacDonald, Donna Peebles, Justin Neil Hook, Gary David Ward, Claudine Elizabeth Ward, Shane Andrew Ward, Gregory Neil Richard Hook (Commercial Fishers); and
  • Marlene Logan, Francine George, James Logan, Phillip George Richie Bee, Cathy Snow on their own behalf and on behalf of the Gkuthaarn and Kukatj people.

The agreement covers an area of about 16,700 sq km, located between the towns of Normanton, Burketown and Karumba.

The purpose of the agreement is, until such a time as the Gkutharrn and Kukatji People's native title determination application has been resolved, to agree to where the Commercial Fishers have rights and interests within that native title determination application area.

The Native Title Representative Bodies for this area under the Native Title Act 1993 (Cth) are the Carpentaria Land Council Aboriginal Corporation and the Queensland South Native Title Services.

Details of the Agreement:

Commencement:

The agreement commenced on 3 June 2015

Termination:

The agreement continues until the first of the following occurs:

  • the proceeding for a determination of native title by consent has been wholly or partly made where, if partly made, that part includes all of the agreement area; or
  • the proceeding for a determination of native title is withdran or stuck out

Native Title Provisions:

The agreement makes no statements in relation to the right to negotiate, extinguishment or future acts.

Native Title in the Area:

The agreement is located in the area that is currently the subject of a native title determination application. As of 23 April 2010, no determination on the Gkuthaarn and Kukatj People's native title rights has been made.
